Terms & conditions

By entering the Friends of Benromach Prize Draw (the “competition”), you accept and agree to be bound by these terms and conditions:

Terms & Conditions

  1. The competition is run by Speymalt Whisky Distributors Limited (“us”, “we”, “the Promoter”) (Company Number SC037522); our registered office is at George House, Boroughbriggs Road, Elgin, Scotland, IV30 1JY, trading as Benromach.
  2. The competition is open to entrants aged 18 years and older. Evidence of address and proof of age may be required. Any entries persons under the age of 18 (or who cannot verify they meet the age requirement) will not be accepted as valid entries.
  3. Employees of the Promoter or their families, agents or anyone professionally connected with the competition or the Promoter are prohibited from entering.
  4. All entries must be submitted on our website.
  5. The content of entries shall not be obscene or vulgar, offensive, abusive, harmful, threatening, libellous, defamatory, invasive of another’s privacy, sexually or racially or ethically or religiously insulting, harassing, abusive, profane or otherwise unlawful, nor contain anything which infringes the intellectual property or other rights of any other person. Any entrywhich we consider to be in breach of this condition may be disqualified from the competition.
  6. The competition opens on 3rd October 2025 and closes at midnight 28th November 2025. No entries will be accepted after competition closing and the Promoter accepts no responsibility for entries made after this date. The winners will be selected from the entries received and notified by 5th December 2025.
  7. Entries are limited to one entry per person. Multiple entries will not be accepted.
  8. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. Incomplete or corrupted entries or those not in accordance with the entry instructions will be rejected.
  9. The Promoter is not responsible for any entries lost, damaged or delayed as a result of any kind of network, computer hardware or software failure of any kind. The Promoter is not responsible for the actions of entrants in connection with this competition in attempting to either circumvent these terms and conditions or interfere with the administration, security, fairness, integrity or proper conduct of the competition. Any entrant found to be tampering with or abusing the entries to this competition or anyone who we believe to be causing error or malfunction or disruption or damage or anyone we consider to be in breach of these terms and conditions may be disqualified from this competition.
  10. The winners will be chosen at random using a computer process from all valid entries received by the closing date.
  11. The winners will be contacted by email by 5th December. All reasonable effort will be made to contact the winners, however, if the winners have not responded by email by 15th December 2025 an alternative winner or winners may be chosen from the entrants or as the Promoter may determine in their sole discretion. The Promoter reserves the right to withdraw the prize for any selected winners that cannot verify their age.
  12. The decision of the Promoter regarding any aspect of the competition is final and binding and no correspondence will be entered into about it.
  13. The prizes are 1 bottle of Benromach 40 Year Old and 5 samples of Benromach 50 Year Old.
  14. The prize is non-transferable and there is no cash or other alternative to the stated prize. However, the Promoter reserves the right to provide an alternative prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond the control of the Promoter.
  15. By entering the competition entrants agree that their personal data submitted as part of the competition process will be stored and processed on their behalf by the Promoter as data controller in accordance with applicable data protection laws and in accordance with the Promoter’s privacy policy [https://retail-gordonandmacphail.com/pages/privacy-policy], as applicable

    a) Entrants agree that such data:

    (i.) includes the entrant’s name, address, contact details and biographical data (including any images, audio and video footage of the entrant) submitted in connection with the competition
    (ii.) may be used by us and by our processors for the purposes of business analysis and research for the administration of, and your participation in, this competition
    (iii.) may be used to contact the winner(s) of the competition and that the winner(s) name(s) will be provided to third parties on request
    (iv.) may be used in marketing and promotional activity in connection with the competition in the legitimate interests of the Promoter.

    b) A request to access, update or correct any information should be directed to us at [[email protected]].
  1. Winners will be required to take part in publicity relating to the competition and recognise that the processing of their name and image is in the legitimate interests of the Promoter in connection with the delivery of this competition and the prizes.
  2. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who writes to Friends of Benromach Prize Draw, Gordon & MacPhail, Boroughbriggs Road, Elgin IV30 1JY (enclosing a self-addressed envelope) within one month after the closing date stated in condition 6. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  3. Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
  4. The Promoter reserves the right to hold void, cancel, suspend, or amend the competition where it becomes necessary to do so.
  5. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. This competition and these Terms & Conditions are governed by Scots law and subject to the exclusive jurisdiction of the Scottish Courts.
