Terms & conditions

1. The distillery experience comprises a tour of the Benromach Distillery, Forres, Scotland including whisky tasting, for only the customer who has duly registered a bottle of the Benromach 50 year old single malt Scotch whisky 2024 purchased by them (the “Benromach 50yo”) accompanied by up to three additional guest nominated by that customer (each of that customer and their nominated guest being a “visitor”).
2. The distillery experience is provided by Speymalt Whisky Distributors Limited trading as Benromach (“us”, “we”, “Benromach”) (Scottish Company Number SC037522); our registered office is at George House, Boroughbriggs Road, Elgin, Scotland, IV30 1JY.
3. The distillery experience is provided by us to each customer who:
   a). purchases a Benromach 50yo, and
   b). before 31^st January 2025 validly completes our product verification process for that Benromach 50yo, and
   c). before 31^st December 2025 validly redeems the distillery experience.
4. Your Benromach 50yo may be verified by scanning the unique QR code on the neck of your bottle] and completing the instructions given. You will need to validate it with the unique product reference code (Prooftag label) uniquely associated with the bottle you have purchased. If you register after 31^st January 2025, you may still complete the product verification, but the distillery experience will not be available to you.
5. The distillery experience may be redeemed by selecting the ‘Redeem Now’ button on the verification website and by filling out your contact details. After this a member of the team will be in touch directly to confirm your booking. The distillery experience shall be at a mutually convenient date and time selected by you from the options available via the online booking process, which options will be subject to availability and capacity at the Benromach Distillery from time to time. Whilst we will use our reasonable endeavours to accommodate your preferences for date and time, we cannot guarantee to meet them. If we are unable to accommodate your preferences for date and time by 31^st December 2025, your entitlement to the distillery experience will expire without penalty to us.
6. The distillery experience must be booked to take place no later than 31^st December 2025, failing which the entitlement to it will expire without penalty to us.
7. The distillery experience may be redeemed only once.
8. There is no additional charge for the distillery experience.
9. The distillery experience does not include travel or accommodation, both of which the visitors must arrange at their own cost.
10. The distillery experience is available only to visitors aged 18 years and older. Evidence of address and proof of age may be required. We reserve the right without penalty to refuse entry to the Benromach Distillery to any visitor not able to prove their age, and will not be obliged to provide a rebooking for the distillery experience or any alternative arrangement in such circumstances.
11. The distillery experience is non-transferable and there is no cash or other alternative to the distillery experience. The distillery experience may not be redeemed or exchanged for money or in kind for any product. However Benromach reserves the right to provide an alternative experience of equal or greater value if the advertised distillery experience becomes unavailable for reasons beyond the control of Benromach.
12. Throughout the distillery experience, each visitor shall comply with:

a). all health and safety and other on-site rules and procedures from time-to-time in force at the Benromach Distillery and communicated to them, and

b). the reasonable instructions of Benromach staff engaged in briefing, supervising or chaperoning visitors.

13. By registering for the distillery experience, you agree that your personal data submitted as part of the registration and booking processes will be stored and processed by Benromach as data controller in accordance with applicable data protection laws and in accordance with Benromach’s privacy policy [https://retail-gordonandmacphail.com/pages/privacy-policy], as applicable.                                                    

a). You agree that such data:

1. includes your name, address, contact details, Prooftag label details and any other biographical data submitted in connection with the product registration process;
2. includes each visitor’s name, address, contact details and any other biographical data submitted in connection with booking the distillery experience;
3. may be used by us and by our processors for the purposes of business analysis and research and for the administration of, and your participation in, the distillery experience;
4. may be used in marketing and promotional activity in connection with the competition in the legitimate interests of Benromach (but will not be utilised for unsolicited direct marketing unless you expressly opt-in to receive it.)

b). A request to access, update or correct any information should be directed to us at dataprotection@gordonandmacphail.com.

 

14. We are not responsible for the actions of customers or others attempting to either circumvent these terms and conditions or interfere with the product registration or booking processes. Any person found to be tampering with or abusing the product registration or booking processes, or anyone who we believe to be causing error or malfunction or disruption or damage, or anyone we consider to be in breach of these terms and conditions may be disqualified from completing the product registration process and/or redeeming the distillery experience.
15. Neither we nor our employees, agents or representatives accept responsibility for any loss, damage or injury incurred by a visitor (or anyone else) as a result of redemption of their prize as far as is permitted by law. Nothing in this condition limits any liability which cannot legally be limited.
16. The distillery experience and these Terms & Conditions are governed by Scots law and subject to the exclusive jurisdiction of the Scottish Courts.
